COLUMBUS -- Ohio Republican election officials thumbed their noses at a subpoena Monday, December 27, as Republican Secretary of State J. Kenneth Blackwell refused to appear at a deposition in an election challenge lawsuit filed at the Ohio Supreme Court. Meanwhile John Kerry is reported to have filed a federal legal action aimed at preserving crucial recount evidence, which has been under GOP assault throughout the state.

NEW YORK - The top Democrat on the House Judiciary Committee has asked The Associated Press and five broadcast networks to turn over raw exit poll data collected on Election Day so that any discrepancies between the data and the certified election results can be investigated.

Rep. John Conyers Jr. of Michigan said in a letter released Tuesday in Washington that the polling firms that conducted the polls on behalf of the news organizations, Mitofsky International and Edison Media Research, had declined to share the information with the committee.

… If the Ohio situation shows anything, it is how lazy, harried, dilettantish, variable, confusing, and sometimes even arbitrary election administration can be in the United States of America… The confusion advantages the more ruthless party, the Republicans: They are willing, as in Florida in 2000, to proclaim victory before all the votes have been counted—taking advantage of the American need for the election to be done with on election night—and to make those who protest sound like whiners, wreckers, or extremists…

As a statewide election recount got underway in Ohio last week, a Democratic congressman called on the FBI to impound vote-tabulating computers in at least one county and investigate suspicions of election tampering in the state.

Rep. John Conyers (D-Michigan), ranking Democrat of the House Judiciary Committee, sought the investigation after an Ohio election official disclosed in an affidavit (.pdf) that an employee of Triad Governmental Systems, the company that wrote voting software used with punch-card machines in 41 of Ohio's 88 counties, dismantled Hocking County's tabulation computer days before the recount and "put a patch on it."…
